JUSTICE BIRENDRA KUMAR ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 201 and 120B of the Indian Penal Code.

The deceased telephonically informed to his brother, the informant of this case that 13-14 persons are forcefully taking him away to commit his murder. When the informant reached at the place, he was informed by the people thereat that 12 persons including the petitioner had taken the deceased.

The case diary does not reveal that who had disclosed to the informant regarding identity of the person involved nor the informant has stated so in the FIR. Only material

Patna High Court Cr.Misc. No.55410 of 2017 (3) dt.04-01-2018 2/2 to suspect the petitioner is that the dead body was found near the business premise of the petitioner surrounded by water logging. Petitioner is in custody since 25.08.2017.

Learned counsel for the informant opposed the prayer for bail.

Considering the aforesaid circumstance against the petitioner, the petitioner deserves bail. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bochhan Police Station Case No. 171 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
