JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,332 and 353/34 of the Indian Penal Code.

The prosecution case is that the police went to apprehend accused Dilip Singh in Hathauri P.S. Case No. 24 of 2012 registered under section 392 IPC since the police was informed that accused Dilip Singh has arrived in the village to perform marriage with petitioner no. 1 whereas petitioner no. 2 is mother of petitioner no.2. When police arrived in the village then the mob including the petitioners attacked the police personnel and

Patna High Court Cr.Misc. No.31388 of 2015 (2) dt.04-08-2015 2/2 caused injury to the informant and others.

It is submitted by the learned counsel for the petitioners that the accusation of attacking the police personnel is not specific against the petitioners and the petitioners have only been roped in the present case because marriage of petitioner no. 1 was fixed with Dilip Singh. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation being omnibus and general in nature and the petitioners being ladies, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani in connection with Madhubani Town P.S. Case No.158 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
