For the Petitioner/s : Mr. Prashant Ved Sen Mr. Subhash Chandra Bose For the Opposite Party/s : Mr. Sri Sanjay Kumari Tiwary 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.

13-07-2016 Heard Sri Prashant Ved Sen, learned counsel assisted by Sri Subhash Chandra Bose, learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Sheikhpura (Kushumbha) P.S. Case No. 209 of 2015 registered for the offence under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail. Learned counsel for the petitioner submits that though in the F.I.R., main accusation was made against one Rohan Singh of firing, which hit on the chest of the deceased, subsequently, the case against said Rohan Singh was found untrue and as such, it is a fit case for extending the privilege of bail, whereas, on perusal of F.I.R., it is evident that there is specific accusation against the

Patna High Court Cr.Misc. No.26813 of 2016 (2) dt.13-07-2016 2/2 petitioner that he fired.

I do not find any ground to extend the privilege of bail.

The petition stands dismissed.
