The petitioner seeks bail in Bettiah Town P.S. Case No. 866/2017, instituted for the offences under Sections 365 and 364 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the F.I.R. is against unknown. During investigation the police has named this petitioner merely on suspicion on the basis of confessional statement of other accused persons as mentioned in paragraphs 44, 48 and 49 of case diary.

The petitioner is in custody since 10.12.2017. Considering the aforesaid fact and circumstances,

Patna High Court Cr.Misc. No.53724 of 2018 (2) dt.26-09-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Town P.S.
