JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pipra Kothi P.S. Case No. 168 of 2018 for the offence under Sections 147, 148, 149, 341, 379, 307, 380 and 354 of the Indian Penal Code.
Allegation against the petitioner is that he was involved in causing injury to the informant Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 18.12.2019.
Referring to the injury report (Annexure-2), counsel for the petitioner submits that the injury is simple in nature. He further submits that co-accused Jobaid Khatoon, Md. Sagir Mian, Afroj Mian, Nayeem Alam have been granted anticipatory
Patna High Court CR. MISC. No.17724 of 2020(2) dt.03-06-2020 2/2 bail by different co-ordinate Benches of this Court. Considering the fact that the petitioner has got no criminal antecedent and the other co-accused have been granted anticipatory bail by different co-ordinate Benches of this Court, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari (East Champran) in connection with Pipra Kothi P.S. Case No. 168 of 2018 with the condition that the petitioner on release will render his service as volunteer for a period of three months in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
