The petitioners seek regular bail in connection with Gopalganj Nagar P.S. Case No. 54 of 2021 instituted for the offences under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2018.
Learned counsel for the petitioners submits that the petitioners are in custody since 23.02.2021, charge-sheet has been submitted in the case and are persons with clean antecedent Learned counsel for the petitioners submits that allegation is of recovery of 433.725 litres of liquor from
Patna High Court CR. MISC. No.28642 of 2021(2) dt.23-11-2021 2/2 ambulance car of which the petitioner was driver and as such was not aware that what was kept in the ambulance. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
Considering the fact that the petitioners are in custody since 23.02.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise, Gopalganj in connection with Gopalganj Nagar P.S. Case No. 54 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
