The petitioner seeks bail in a case instituted for the offences under Sections 363, 365, 379, 395 and 412 of the Indian Penal Code.

The prosecution case in short is that while returning to his house after unloading the vehicle, the husband of the informant was missing.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.8.2018. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Charge-sheet has been submitted in the present case. The

The name of the petitioner has transpired on the basis of diclosure made by co-accused. Except for suspicion, there is no other substantive evidence to suggest his implication in the present case. No incriminating article is said to have been recovered from the petitioner. The petitioner has remained in custody for about eight months. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-7th, Nalanda, Biharsharif in connection with S. Tr. No. 699 of 2018 arising out of Laheri P.S. Case No. 313/17.
