The petitioner seeks anticipatory bail in connection with Phulparas P.S. Case No. 31 of 2014 registered for the offence punishable under Sections 498A, 379, 323, 341 of the Indian Penal Code, 3 and 4 of the Dowry Prohibition Act. It has been contend that prior the lodging of the FIR,

No.36283 of 2014 (2) dt.01-04-2015 2 / 2 the petitioner has lodged Matrimonial (Divorce) Case No. 26 of 2014 on 25.01.2014 before the learned Principal Judge, Family Court, Madhubani and when the informant came to know about it then she lodged the present case after delay of 3 days i.e. on 28.01.2014.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, let the petitioner be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Jhanjharpur, District-Madhubani in connection with Phulparas P.S. Case No. 31 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C.
