Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Masuadhi P.S. Case No. 336 of 2022 registered for the offence under Sections 147, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

The prosecution story in short is that on 10.06.2022, the informant, his brothers namely Ankit Kumar and Mantu Kumar were in his shop and at about 06:20 hrs, 8 to 10 persons came with south side armed with Baari and iron road and they attacked the informant's cousin namely Ankit Kumar.

No.20534 of 2023(2) dt.22-05-2023 2/3 When the informant and one cousin brother namely Mantu Kumar ran to rescue Ankit Kumar, they saw that Ankit Kumar sustained serious head injury and they tried to catch the accused persons, the accused persons assaulted them and threatened them.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2022 and the petitioner's name has come on the confessional statement of the co-accused Md. Inam @ md. Imam and the petitioner is quite innocent and has falsely been implicated in this case.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Masaudhi, Patna/concerned Court below in connection with Masuadhi P.S. Case No. 336 of 2022. The petitioner will visit Masaurhi Police Station on the first Sunday of each month.
