JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody since 4.4.2016 in a case registered for the offences under Sections 302 and 201 of the Indian Penal Code.

One unknown dead body was recovered for which the present case was lodged. However, in course of investigation, the dead body was identified by family members of the deceased and it came to light that the petitioner and some other friends of the deceased used to meet him but after the present occurrence, they did not turn up to the house of the deceased. However, the family members of the deceased claimed that the deceased was killed by the petitioner and his associates with intent to grab the money of

Patna High Court Cr.Misc. No.27297 of 2016 (3) dt.05-09-2016 the deceased. The investigation against the petitioner has already been completed and except suspicion there appears nothing against the petitioner.

Considering the aforesaid facts as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 257 of 2015.
