====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Sasaram (Darigaon) P.S. Case No. 839 of 2021 lodged under Sections 379 and 411 of the Indian Penal Code. As per the prosecution, case is filed against unknown and allegation of theft of a motorcycle kept before the hotel has been made by the owner of the motorcycle along with mobile and Rs. 500/- which were kept in the motorcycle. Learned counsel for the petitioner submits that he is not named in the F.I.R. and he is actually resident of Hazaribagh, he went to his friend's house namely Rahul to Aurangabad from Hazaribagh and as per their programme, they have visited to Sasaram to see the tomb of Sher Shah Suri and

No.19353 of 2022(2) dt.20-07-2022 2/2 Tara Chandi, due to shortage of petrol they have standing near NH-2 by parking their motorcycle near a petrol pump and under suspicion, they were arrested by the police assuming that they are thieves. Nothing has been recovered from the possession of the petitioner. It has been further submitted that petitioner is a student, reading at Hazaribagh, he is in custody since 23.10.2021 and charge sheet has already been filed in this case. Neither any recovery nor any T.I.P. has been taken place of the petitioner.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Sasaram, Rohtas in connection with Sasaram (Darigaon) P.S. Case No. 839 of 2021, subject to the conditions as laid down under Section 437(3) of the Cr.P.C. Accordingly, the bail application stands allowed. (Dr. Anshuman, J.) guddu/- U T
