JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Pirbahore PS Case No. 264 of 2017 (Special Case No. 75 of 2017) registered under Sections 274, 275, 276, 284, 379, 406, 413, 414, 419, 420, 467, 468, 476, 120B of the IPC, Sections 27, 28, 30 of Drugs and Cosmetics Act and Sections 22 and 23 of NDPC Act. The allegation in brief is that the Drug Inspector raided several premises, including the premises of the petitioner, recovered expiry drugs and suspicion is raised that those drugs may be spurious.
Learned Counsel for the petitioner submits that the petitioner is not having any drug license rather his son Niraj Kumar has a drug license and he has been admitted to bail by a coordinate Bench of this Court, moreover there is no provision under he Drugs and Cosmetics Act for institution of police case. The petitioner is in custody since 26.9.2017.
Having considered the said facts and circumstances, the petitioner, namely, Naresh Prasad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
