JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-07-2020 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The petitioners, who are three in number, are apprehending arrest in connection with Gangta P.S. Case No. 67 of 2019 and G.R. No. 2060 of 2019 for offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners would submit that petitioners have no criminal antecedents. It is further submitted that there is case and counter case between the parties and the police after investigation submitted charge sheet under Sections 341, 323, 504, and 506/34 of the Indian Penal Code but the
Patna High Court CR. MISC. No.17637 of 2020(2) dt.13-07-2020 2/2 court below has taken cognizance of the offence under Sections 341, 323, 504, 506 and 307/34 of the IPC. Learned counsel for the petitioners submits that nature of injury sustained by the injured is simple.
Considering the nature of the injury and the petitioners have no criminal antecedents, the Court is inclined to grant bail to them subject to the condition that the petitioners have to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Munger in connection with Gagta P.S. Case No. 67 of 2019 and G.R. No. 2060 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Deposit of Rs.25,000/- (Rupees twenty thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
