The petitioner is apprehending his arrest in a case initially registered under Sections 406, 419, 420, 120(B), 323, 504 of the Indian Penal Code, in which, later on, cognizance was taken under Sections-406, 418, 420 of the Indian Penal Code. The prosecution case, in brief, is that some money was deposited in Lokmanya Sangh which was misappropriated. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is an employee of the Lokmanya Sangh. The

Patna High Court CR. MISC. No.20696 of 2019(2) dt.04-04-2019 2/2 informant is said to be one of the depositors. The money in question was not received by the petitioner. No entrustment was made to the petitioner. The petitioner has been made accused in the present case due to mistake of fact.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 1230 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
