Petitioners, already in custody, seek bail in connection with Hilsa P.S. Case No.638 of 2017, registered under Sections 147, 148, 353, 307, 332, 333, 186, 187, 115, 153(B), 295(A), 341, 120(B) and 325 of the Indian Penal Code.

Allegation in brief is that the large number of people of the other community started throwing brick bats on a religious procession of the another community and tried to indulge in communal riots.

Learned counsel for the petitioners submits that though the petitioners are named in the FIR along with the large

No.57512 of 2017 (2) dt.12-12-2017 2 /2 number of persons however, no specific overt act is alleged against them and the nature of injuries on one or two person is simple in nature and another co-accused Sumit Kumar similarly situated has been admitted to bail by this Court vide Cr. Misc. No.56115 of 2017 on 23.11.2017.

Having considered the said facts and circumstances, let petitioners, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Hilsa (Nalanda) in connection with Hilsa P.S. Case No.638 of 2017.
