JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioners, the informant and the learned A.P.P. for the State.

The petitioners seek bail in Pandaul P.S. Case No. 06/2018, instituted for the offences under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is land dispute between the parties.

Allegation against petitioner no. 1 is that he assaulted the informant with Tangari on the head and petitioner no. 2 assaulted the informant with bamboo stick on her back. When mother of informant came to save her, petitioner no. 2 assaulted

Patna High Court Cr.Misc. No.53778 of 2018 (2) dt.27-09-2018 2/2 her with iron rod.

Injury report is enclosed as Annexure-2 to the bail petition, which shows that informant has sustained two injuries, which is opined to be simple in nature caused by sharp cutting weapon.

Learned counsel for the informant has opposed the prayer for bail of the petitioners.

The petitioner is in custody since 12.07.2018. Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 06/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
