JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Chhatapur P.S. Case No. 14 of 2017, G.R. No. 123 of 2017, disclosing offences under Sections 363, 365, 120(B) of the Indian Penal Code.
Allegation against the petitioners is of kidnapping the minor son of the informant.
Submission of the learned counsel for the petitioners is that the whole prosecution case is false and concocted and the victim has gone to Andhra Pradesh and returned to the house and in collusion with the father he has stated against the petitioner.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.18330 of 2019(3) dt.18-06-2019 2/2 for bail on the ground that in his statement under Section 164 of Cr.P.C. the victim has named this petitioner also. Having heard both sides, in view of the facts, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the trial court on the materials available on record, without being prejudiced by the order of this Court.
