ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Alauli P.S. Case No.66 of 2015 for allegedly having committed the offence under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that only because the deceased was reported to have been taking liquor in the company of the present petitioners and subsequently his body was found, that the petitioners have been roped in the present case. Learned counsel further submits that the deceased was a habitual drinker and, as such, the entire claim for his murder cannot be saddled on the shoulders of these petitioners.

No.32727 of 2015 (2) dt.18-08-2015 2/2 Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate,Khagaria, in connection with Alauli P.S. Case No.66 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
