ANJANA MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.07.2018 in connection with Araria P.S. Case No.473 of 2018 and Special Case No.827/18 registered for the offence under Sections 30(a)/36/37(2)/38 of the Bihar Prohibition and Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from the place known as "Mushari in Jai Prakash Nagar". It is further submitted that the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on
