The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, as a result of firing it is stated that the nephew of the informant who was in the house was shot and died on the spot. On the informant coming out, it is stated that he recognized Arvind Mahto, Kumod, Kare Mahto and Sajan. He did not identify the 10 other accused. It is stated that on making inquiry it transpired that an occurrence had taken place few days earlier and in retaliation thereto the petitioner and others had gone to take revenge.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.29684 of 2021(3) dt.11-02-2022 2/2 that the petitioner has been falsely implicated in the case. There is no direct or specific allegation against the petitioner. There are no eye-witness to the occurrence. The petitioner is in custody since 23.9.2020 and charge sheet has been in the case. No material has transpired in course of investigation to connect the petitioner with the alleged crime.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year 4 months, the Court directs the petitioner to be enlarged on bail in connection with Maranchi (Pachmahla O.P) P.S. Case no. 47 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Barh, District Patna.
