There happens to be an allegation at the end of the informant that his wife/ victim has been allured at the end Rubi Devi, Rahul Yadav, Santosh Yadav, Gore Yadav, wife of Gore Yadav and in the aforesaid background, she left his place in the mid night of 30.04.2017. He also came to know that she is under captive of Rahul Yadav, Santosh Yadav (petitioner). The aforesaid occurrence took place on 30.04.2017, while written report has been filed on 01.06.2017. Victim in her statement under Section 164 of the Cr.P.C. has not only controverted the allegation having at the end of the informant by stating that in the day time, she was kidnapped while was in a way to her Naihar and further, the
Patna High Court Cr.Misc. No.53394 of 2018 (02) dt.12-09-2018 journey, which she covered in company of Rahul Yadav and Santosh Yadav speaks a lot, more particularly in the background of being a grown up, major lady as well as considering the fact that co-accused Rahul Yadav has already been granted bail vide Cr. Misc. No.43771 of 2018. Petitioner, Santosh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2nd, Naugachia, Bhagalpur in connection with Kharik P. S. Case No.88 of 2017.
