JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 302, 120B and 379 of the Indian Penal Code. Allegation is that the accused persons assaulted son of the informant and pushed him into the well. Thereafter, he was brought out from the well and taken to hospital where he died. It is also alleged that Rs.10,000/- and a mobile phone was taken out from the pocket of the deceased.
It has been submitted on behalf of the petitioner that he is in custody since 6.1.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Altogether nine persons are named in the F.I.R. Petitioner is not named in the F.I.R. In course of investigation it is alleged that petitioner was also present at the place of occurrence. No overt act has been alleged against him.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.29801 of 2016 (3) dt.06-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachatti (Mohanpur) P.S. Case no. 2 of 2016.
