The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a young boy aged about 18 years and the informant alleges that Banti and Sangar were arrested who disclosed that the diesel engine was stolen and also disclosed the name of the accused persons including the petitioner who fled after seeing the police.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such,

No.19164 of 2023(2) dt.23-06-2023 2/3 nothing was recovered from his conscious possession, it is next submitted that he came to be implicated based on confessional statement of co-accused in police custody which does not have any evidentiary value. It is next submitted that petitioner is a young boy with clean antecedent and in the event, if he is sent to judicial custody chances are bright that he may come in contact with hardened criminals and his entire career may get jeopardize.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lalganj P.S. Case No. 23 of 2023 subject to the conditions as laid down under Section 438
