The petitioner is languishing in custody since 12.07.2018 in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

It is alleged that on 14.06.2018 at 9:00 p.m. motorcycle borne miscreants robbed informant's Rs. 4,10,000/-, leading to registration of the FIR against unknown. The name of the petitioner sprang up on the statement of apprehended coaccused Pratap Kumar @ Pandit Jee. It is submitted by learned counsel for the petitioner that neither there is any recovery from possession of the petitioner nor the petitioner has been put on T.I. Parade and co-accused apprehended Pratap Kumar @ Pandit Jee has been granted bail vide order dated

Patna High Court CR. MISC. No.19531 of 2019(2) dt.01-04-2019 2/2 29.09.2018 passed in B.P. No. 1096 of 2018 by learned 1st Additional Sessions Judge, Nalanda at Biharsharif. Learned APP submits that the name of the petitioner sprang up on the confession of co-accused.

Considering the fact that the material on record does not suggest that the petitioner has been put on T.I. Parade and the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Nalanda at Biharsharif in connection with Chhabilapur P.S. Case No. 36 of 2018.

Since the petitioner is having criminal antecedent, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities; if the petitioner defaults for two consecutive occasions or gets involved in some serious nature of offence.
