JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-01-2015 The petitioner nos. 3 and 4 have been arrested and their Criminal Miscellaneous has been dismissed as infructuous. Heard the parties.

In this application for anticipatory bail the petitioners apprehend their arrest for the offence punishable under Sections 304B and 201/34 of the Indian Penal Code.

Allegedly, for non-fulfilling the demand of dowry by way of motorcycle, the daughter of the informant was killed and her dead body was also made traceless. The petitioners are the relatives of the husband of the daughter of the informant and are living in another village and the husband of the deceased is already in custody.

Patna High Court Cr.Misc. No.31219 of 2014 (3) dt.29-01-2015 Submission is that petitioners have falsely been implicated in this case. Petitioner no. 1 is the married Nanad and petitioner no. 2 is the Nandosi and they deserve sympathetic consideration to which the learned A.P.P. does not oppose. In the facts and circumstances as stated above, considering that there is general and omnibus allegation against the petitioner no. 1 Nitu Devi and petitioner no. 2 Lakhindra Singh, in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order they shall be released on bail on execution of bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 40 of 2014, subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
