Verma, learned senior counsel, assisted by Sri Shekhar Harshvardhan, learned counsel for the petitioners and Sri Anand Kishore Choudhary, learned Additional Public Prosecutor.
Two petitioners, who are in custody since 03.10.2017 in connection with Nokha P.S. Case No. 299 of 2017, registered for the offence under Section 147, 148, 149, 341, 323, 307, 353, 436, 427, 504, 153(A), 295A, 505C of the Indian Penal Code , 1860 have prayed for grant of bail.
By way of referring to the F.I.R., learned counsel for the petitioners submits that while procession of Maa Durga statue was moving, dispute had taken place in between two

No.55561 of 2017(2) dt.29-11-2017 2/2 communities and Police maliciously protecting one community has arrayed number of persons of the other community as accused and petitioners, without any specific allegation, have also been made accused as member of the mob. Considering the nature of accusation and the fact that petitioners are in custody, let both the petitioners Munna Kumar @ Raj Kumar Verma and Mohit Kumar Verma @ Mohit Kumar Varma @ Mohit Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas / concerned court in connection with Nokha P.S. Case No. 299 of 2017 .
