The instant application for regular bail has been filed by the petitioner for the offence punishable under Sections 363, 366A/34 of the IPC and Section 8 of the POCSO Act. Charge sheet has been submitted u/s 366A of IPC, Sections 8 and 12 of the POCSO Act and cognizance has been taken for the offence u/s 366A, 363, 376 and 120B of the IPC, Sections 4 and 8 of the POCSO Act.

Prosecution case relates to abduction of minor daughter of the informant by the petitioner and others by Bolero vehicle and threatened to kill the daughter of the informant if she will to the police.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

There is love affair between the co-accused, namely, Aslam Ansari and daughter of the informant so, the victim girl has twice eloped with him and returned too. Statement of the victim girl was recorded u/s 164 Cr.P.C. in which she has not raised any finger against the petitioner for any misbehavior or sexual assault. Petitioner is languishing in judicial custody since 24.09.2022.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 6th-cum-Special Judge (POCSO), West Champaran at Bettiah in connection with Majhauliya P.S. Case No. 86 of 2022.
