JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 397, 307/34 of the Indian Penal Code. The present case was lodged on the basis of complaint petition. The petitioner and 12 other persons are named in the first information report and there is specific allegation against the petitioner and two others that they, indiscriminately, assaulted the informant by means of Dabiya, causing altogether 8 injuries on the head of injured but submission on behalf of petitioner is that only three injuries were found on the person of the injured and so far as injury on the head is concerned; only one

Patna High Court Cr.Misc. No.26233 of 2016 (2) dt.05-07-2016 2/2 injury was found on the head of the injured, which is evident from perusal of Annexure-2 to this petition. It is further submitted that moreover, some co-accused, having more or less similar allegation, have already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 26-05-2016 passed in Cr. Misc. No. 15053 of 2016.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kesaria P.S. Case No. 294 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
