JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 397 of the Indian Penal Code.
Petitioner is not named in the first information report but from perusal of impugned order, it would appear that the name of petitioner surfaced in this case in the statement of some witnesses in course of investigation.
Learned counsel, appearing for the petitioner submits that having more or less similar allegation, one co-accused namely, Ram Kumar Rai has already been granted privilege of bail by a coordinate bench of this court by order dated 21-06-2016 passed in Cr. Misc. No. 15833 of 2016 and while granting the bail
Patna High Court Cr.Misc. No.26239 of 2016 (2) dt.05-07-2016 2/2 to above-said co-accused, Ram Kumar Rai, the concerned bench doubted about the credibility of statements of the above-said witnesses.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jokihat P.S. Case No. 248 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria. (Hemant Kumar Srivastava, J) A.K.V./- U T
