Petitioner is an accused in a case registered for offence under sections 341, 323, 324, 307, 504 and 34 IPC. Counsel for the informant opposes the prayer for bail by submitting that the petitioner has caused grievous injury on the victim.
Counsel for the petitioner submits that at best it can be said that due to tension the petitioner hurled Farsa blow on the informant causing injury on his head, though the assault was not premeditated. Petitioner has no antecedent and he is in custody since 19.9.2017. Occurrence is of 16.6.2017 and the FIR was lodged on 2.7.2017.
Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned
Patna High Court Cr.Misc. No.63434 of 2017 (3) dt.17-02-2018 above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VI, Siwan in Pachrukhi (Sarai) Police Station Case No. 137 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(b) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
