JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section394 of the Indian Penal Code. Petitioner is not named in the first information report and his name appears to have surfaced in this case in course of investigation. The learned Additional Sessions Judge did not take pain to mention the facts, which have come against the petitioner in course of investigation and it has simply been observed by the learned Additional Sessions Judge in his impugned order that in course of investigation, the complicity of the petitioner was found in this case. However, it is submitted on behalf of petitioner that except confessional statement of the petitioner, there is nothing
Patna High Court Cr.Misc. No.26247 of 2016 (2) dt.05-07-2016 2/2 against him. The petitioner is languishing in jail custody since 2202-2016 and it appears that uptill now, he has not been put on test identification parade.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mansoorchak P.S. Case No. 17 of 2010 to the satisfaction of Chief Judicial Magistrate, Begusarai.
