The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 341, 323, 307, 34, 498(A) of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

The prosecution case in short is that due to non-fulfillment of dowry, the informant was subjected to cruelty and on 18-10-2019, the petitioner who happened to be brother the informant's husband set fire upon her persons with connivance and assisting with other coaccused including her husband. It has been submitted on behalf of the petitioner that the

Patna High Court CR. MISC. No.16870 of 2020(2) dt.02-06-2020 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 03-12-2019. Charge sheet has already been submitted. The petitioner is brother-in-law of the deceased. He is separate in mess and property from husband of the victim. He has no concern with the affairs of husband of the victim. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur Patna in connection with Naubatpur P.S. Case No. 701 of 2019. Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
