The petitioner apprehends his arrest in Minapur P.S. Case No.460 of 2020, registered for the offences punishable under Sections 272, 273, 120(B), 34 of the Indian Penal Code, Section 30(a)/37(b) of the Bihar Prohibition and Excise Act as well as under Sections 8(c)/20/21/22 of the NDPS Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is no recovery from the conscious possession of the petitioner rather 645 litres of illegal spirit and 10.500 kg. of Ganja was recovered from the place of occurrence. It is further submitted that the apprehended person disclosed the name of the petitioner.

Patna High Court CR. MISC. No.29085 of 2021(2) dt.17-12-2021 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the fact that huge quantity of illegal spirit and Ganja was recovered from the place of occurrence, I am not inclined to enlarge the petitioner on anticipatory bail.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
