JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 376, 511 and 506/34 of the Indian Penal Code. Petitioner is in jail custody since 3.3.2016 on the accusation that he made abortive attempt to commit rape on the informant.

Submission on behalf of the petitioner is that petitioner happens to be agnate of the informant and, as a matter of fact, this false case has been lodged on account of previous enmity. It is further submitted that moreover, charge sheet has already been submitted and the case has already been

Considering the aforesaid facts and circumstances, the period of detention of the petitioner in jail custody as well as above stated submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Kundwachainpur P.S. Case No.86 of 2014.
