JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 25.03.2016 in a case registered under section 341, 323, 324, 387, 307, 506/34 of the Indian Penal Code and 27 of the Arms Act.

The occurrence appears to have taken place on account of land dispute and it is alleged that petitioner gave iron rod blow causing head injury to the injured of this case. The informant claims that injured was taken to the hospital and, subsequently, for better treatment, he was referred to Patna as well as Delhi but the impugned order of the learned Additional Sessions Judge does not refer any injury report of injured.

No.26260 of 2016 (2) dt.05-07-2016 2/2 Learned counsel for the petitioner submits that even after lapse of near about four months, the I.O could not succeed to collect any injury report of the injured and, moreover, the investigation against the petitioner has already been completed. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Turkauliya P.S.Case No. 841 of 2015.
