JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-05-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four week after start of normal functioning of the Court. Heard learned counsel for the petitioner and learned APP for the State.
This application has been filed for modification of the order dated 02.02.2021 passed in Cr. Misc. No. 26870 of 2020 with regard to extension of time to surrender before the learned court below.
Learned counsel for the petitioner submits that the petitioner was granted privilege of anticipatory bail vide order dated 02.02.2021 passed in Cr. Misc. No. 26870 of 2020 in connection with Special Excise Case No. 48 of 2020 arising out of Barhara P.S. Case No. 28 of 2020 but she could not furnish the bail bond before the learned court below within the prescribed time.
In the given facts and circumstances of the case and
Patna High Court CR. MISC. No.25115 of 2021(2) dt.20-05-2021 2/2 on being satisfied with the explanation offered on behalf of the petitioner, this Court directs that the period of four weeks for furnishing bail bond will now be counted from the date the Civil Court starts functioning after the present pandemic situation. If the petitioner furnishes her bail bond within four weeks after start of functioning of the Court for the purpose of acceptance of bail bond, the same will be accepted in terms of the order dated 02.02.2021 passed in Cr. Misc. No. 26870 of 2020 and benefits thereof shall be granted to her. The other terms and condition shall remain intact.
