This is an application for bail in connection with Laukahi P.S.Case No. 88 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307, 498A, 494 and 34 of the Indian Penal Code.

Allegation against the petitioner is of committing cruelty and also assaulting the informant, who is said to be his wife. Submission of learned counsel for the petitioner is that earlier also she had lodged same type of case and he is in custody for six months.

Having heard both sides and considering the facts and

No.55841 of 2017 (2) dt.22-11-2017 2/2 circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Jhanjharpur, Madhubani, in connection with Laukhi P.S.Case No. 88 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.

If an application for maintenance is filed by his wife, he will co-operate in disposal of the same, otherwise informant shall be at liberty to move for cancellation of his bail bond. (Vinod Kumar Sinha, J) spal/- U
