JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-03-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 386, 387/37 of the Indian Penal Code and Section 17 of Criminal Law Amendment Act. It is submitted that the petitioner has not been named in the FIR. During investigation, the name of the petitioner and others has appeared in the confessional statement of co-accused Dasarath Ram @ Munna @ Bajarangi. In similar facts and circumstance, the co-accused Rajesh Ram has been granted bail vide Cr. Misc. No.26740/2014. Nothing has been recovered from the possession of the petitioner. He has no criminal antecedent.

Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Girish Mishra, Judicial Magistrate, 1st Class, Motihari, East Champaran in Dumariyaghat P.S. Case No.07/2014 with the following conditions :

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
