Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation is that the FIR named accused persons under a conspiracy called the deceased to their house and thereafter committed his murder and hanged the body with a tree. Submission of the learned counsel for the petitioner is false implication on suspicion only. Contention is that the Doctor has not found any external injury and the opinion regarding cause of death is still awaited till viscera report. Two other accused persons have been allowed bail by a Coordinate Bench of this Court vide Annexure-

2. He further submits that the case diary would also reveal that there is no eye-witness of the occurrence.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Siwan Muffasil (Dhanauti O.P.) Police Station Case No. 86 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
