Petitioner, already in custody, seeks bail in connection with Naubatpur P.S. Case No.231 of 2016, registered under Sections 302, 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that due to land dispute, the agnates of the informant, the petitioner and his two sons and one Jitendra Kumar entered into the house in the night and shot at his father.

Learned counsel for the petitioner submits that both sides are agnates and there is family dispute and father and both sons have been implicated in this case, there is no evidence that who

No.59858 of 2017(5) dt.21-02-2018 2/2 shot at the deceased, this petitioner has no criminal antecedent, only one fire arm injury is found on the body of the deceased, investigation has been completed and the petitioner is in custody since 25.07.2017. Petitioner is an old man, the right part of the body of the petitioner is affected by Polio and there is disability of 45%.

Having considered the said facts and circumstances, petitioner Ram Naresh Singh @ Ram Naresh Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Danapur, Patna in connection with Naubatpur P.S. Case No.231 of 2016 with condition that the petitioner shall remain present before the trial court on each and every date and if he absents himself on two consecutive dates without any reasonable ground, his bail bond shall liable to be cancelled.
