The petitioner apprehends his arrest in a case registered under Section 366A/34 of the Indian Penal Code. The informant made an allegation that Vijayanti Devi, her husband and their son kidnapped her minor daughter Rekha Kumari.
Learned counsel for the petitioner submits that Rekha Kumari appeared before the learned Sessions Judge and she disclosed that she solemnized marriage with the petitioner and she was carrying pregnancy.
Learned Additional P.P. pointed out that the victim Rekha Kumari is a minor.
Considering the fact that the victim herself
Patna High Court Cr.Misc. No.34240 of 2014 (2) dt.12-02-2015 2/2 disclosed that she married with the petitioner and she carries pregnancy, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Garkha P.S. Case No.168 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
