The sole petitioner, who is in custody in Nathnagar ( Madhusudanpur) P.S. Case no.236/2015 registered for the offence under Sections 413, 414 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that one of the co-accused, namely, Gaurav Kumar was granted bail by this Court on 25.05.2016 vide Cr.Misc.No.22584 of 2016. Thereafter, other two accused persons, namely, Fantus Kumar and Bhagwat Mandal were also extended the privilege of bail by the learned court below itself.
Patna High Court Cr.Misc. No.26865 of 2016 (2) dt.13-07-2016 2/2 Keeping in view the fact that in similar circumstances, other three accused persons have already been granted bail, there is no reason to further detain the petitioner. Let the petitioner, namely, Mukesh Mandal be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Addl. Sessions Judge, Bhagalpur in connection with S.T. No.169/2016 corresponding to Nathnagar ( Madhusudanpur) P.S. Case no.236/2015.
