Petitioner being the mother-in-law of the deceased is said to have sprinkled kerosene oil and lit fire on the person of the deceased. The deceased was admittedly in hospital on 20.11.2013 and on 23.11.2013 her fardbeyan was recorded and in the said fardbeyan she specifically stated that it was this petitioner who lit fire on her. The deceased died in course of her treatment and thereafter her statement becomes her dying declaration. No doubt, the investigation against the petitioner has already been completed but taking note of allegation recorded against the petitioner as well as facts and circumstances of the case, I am not inclined to release her on bail at this stage. Accordingly, her prayer for bail in connection with Rupaspur

Patna High Court Cr.Misc. No.30277 of 2016 (3) dt.20-10-2016 2/2 P.S.Case No.252 of 2013 pending in the Court of ACJM, Danapur stands rejected.

However, learned ACJM, Danapur is directed to commit the case of the petitioner to the Court of Sessions in accordance with law within a week from the date of receipt/production of a copy of this order and after commitment the concerned Sessions Court shall expedite the trial of the petitioner and conclude the same as early as possible preferably within a period of four months from the date of framing of the charge.
