Petitioner seeks bail in a case registered under section 363/34 of the Indian Penal Code and later on, sections 302, 364/34, 120B of the Indian Penal Code were also added. The name of the petitioner surfaced in this case in the confessional statement of co- accused Anish Sah and subsequently, on the basis of confessional statement of co- accused Anish Sah, some bones and clothes were recovered.

Learned counsel for the petitioner submits that except socalled confessional statement of co- accused Anish Sah, there is nothing against the petitioner and moreover, in confessional statement of co- accused Anish Sah, general allegation has been levelled against the petitioner.

Considering the aforesaid facts and circumstances as well as

No.23769 of 2016 (3) dt.13-07-2016 submissions of the parties and also taking note of this fact that police submitted charge sheet against the petitioner only on the above stated confessional statement of co- accused, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Riga P.S. Case no. 219/2015.
