The petitioner seeks bail in anticipation of his arrest in connection with Agiaon Bazar P. S. Case No. 142 of 2020, instituted for the offences under Sections 341, 323, 325, 308, 379, 506 and 34 of the Indian Penal Code.

The accusation against the petitioner and others is of assaulting the members of the prosecution party by means of knife, rod, danda etc.

No.28679 of 2021(2) dt.17-01-2022 2/3 It has been urged on behalf of the petitioner that the informant and his associates stay in the same campus and the petitioner is an agnate of the informant. The mother of the petitioner has also filed a case against the informant of the present case vide Agiaon Bazar P. S. Case No. 143 of 2020.

The injuries received by the victims are all reported to be simple in nature.

There was a dispute between the parties with respect to drainage of water as the prosecution side had opened the outlet of the water tank in the main entrance way of the petitioner. At the time of the assault, so described in the FIR, there was water logging for which a protest had been made but such protest took an ugly turn and both the parties fought amongst themselves. Regard being had to the aforesaid background facts and taking into account that the other accused persons of this case have been released on bail by the court below, the petitioners, above-named, are directed

No.28679 of 2021(2) dt.17-01-2022 3/3 to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhojpur at Ara, in connection with Agiaon Bazar P. S. Case No. 142 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
