====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-01-2022 Heard Mr. Bhola Prasad, learned Advocate for the petitioner and Mr. Mukesh Kumar Singh, learned Additional Public Prosecutor for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Azamnagar P. S. Case No. 01 of 2021 instituted for the offences under Sections 341, 323, 324, 307, 379, 354, 504 and 506/34 of the Indian Penal Code.

The petitioner is alleged to have given a knife blow to the son of the informant in a Panchayati which was being held at the house of the Sarpanch to settle the dispute between the son and daughter-in-law of the informant.

The learned counsel for the petitioner has submitted that though he is alleged to have used a knife in hurting the son of the informant, but the injury suffered by the victim is simple

Assuming but not admitting the aforesaid accusation, it has been urged on behalf of the petitioner that in the moment of heated discussion between the two sides, namely of the groom and the bride, an occurrence took place in which the victim has received injury.

The petitioner is only a co-villager of the bride. Considering the afore-noted background facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Azamnagar P.S. Case No. 01 of 2021, subject to the condition as laid down under Section 438 (2) Cr. P.C. The application stands allowed.
