13-07-2020 Heard learned counsel for the parties through video conferencing.
This relates to grant of bail in Rampur P.S. Case No. 103 of 2012 registered for the offence under Section 364(A) of the Indian Penal Code.
It is case of kidnapping of son of informant for ransom of Rs. 75 lacs and name of petitioner has transpired during course of investigation.
Learned counsel for the petitioner submits that petitioner has committed no offence and he has falsely been implicated in this case. Petitioner is not named in the F.I.R. He further submits that during course of investigation, the victim boy has already been recovered from the house of co-accused Harendra Singh and petitioner has no connection with the
Patna High Court CR. MISC. No.19409 of 2020(3) dt.13-07-2020 2/2 alleged occurrence. No incriminating article has been recovered from the possession of petitioner and he is in custody since 23-10-2019.
However, learned A.P.P. for the State has opposed the prayer for bail and submits that the victim boy, in his statement recorded under Section 164 Cr.P.C., has named the petitioner, as the person who was also sitting in the Bolero alongwith other accused, whereby he was kidnapped on gun-point. Considering the aforesaid facts & circumstances as well as statement of the victim recorded under Section 164 Cr.P.C., I am not inclined to extend the privilege of bail to the petitioner.
The bail application stands dismissed.
