JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsels for the petitioners, informant and learned counsel for the State.

The petitioners are languishing in custody since 25.04.2016 in connection with Korha P.S. Case No. 246 of 2015 for the offences instituted under Sections 147, 148, 149, 342, 324, 379 and 307/34 of the IPC. Later on, Section 326 of the IPC was also added.

The prosecution story, in brief, is that on 21.12.2015 in the morning, the informant's husband had gone to Potato field where he was surrounded by the petitioners alongwith other coaccused and at that time petitioners caused injuries to the informant and her husband through Farsa and Dabiya, which were found to be grievous in nature.

No.30883 of 2016 (5) dt.17-10-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 25.04.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. They have got no criminal antecedent. The petitioners have falsely been implicated in the present case due to previous enmity. It is further submitted that the petitioners are ready to deposit an amount of Rs. 15,000/-(Rupees Fifteen Thousand) jointly in the court below which may be released in favour of the informant. On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs. 15,000/- (Rupees Fifteen Thousand) jointly in the court below which shall be released in favour of the informant and on doing so, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Korha P.S.
