JUSTICE ARUN KUMAR ORAL ORDER 07-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Paroo PS Case No. 77 of 2017 registered under Sections 147, 148, 149, 342, 323, 324, 302 and 307 of the IPC.
The allegation in brief is that while the deceased was going on a motorcycle hit a she-goat and the local people leached him and another person accompanying him namely Sakindra Sahani was badly assaulted.
Learned Counsel for the petitioners submits that in the entire case diary there is no eye witness making statement regarding involvement of the petitioners, even the informant is not an eye witness and above all Sakindra Sahni, who is the only eye witness of the case but his statement has not been recorded and charge-sheet has been submitted in this case. The petitioners have no criminal antecedents and are in custody since 17.4.2017 and 26.6.2017 respectively.
Having considered the said facts and circumstances, the petitioners, namely, Pappu Manjhi and Gorakh Manjhi @ Ram
Patna High Court Cr.Misc. No.235 of 2018 (3) dt.07-02-2018 Ashish Manjhi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each to the satisfaction of Sub Judge 3rd - cum ACJM West Muzaffarpur in connection with Paroo PS Case No. 77 of 2017.
