The petitioner is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323 and 354 of the Indian Penal Code. The prosecution case is that the complainant's daughter Rina Kumar gone to ease when the petitioner lifted her and took her to his house with intention to ravish her. On alarm being raised when the villagers reached at the place of occurrence then the accused persons escaped from

It is submitted by learned counsel for the petitioner that for the occurrence of 01.12.2013 the complaint was filed on 05.12.2013 whereas the petitioner filed Maner P.S. Case No. 452 of 2013 on 01.12.2013 and as a retaliatory measure the present case has been lodged.

Considering the delayed lodging of the case and the case lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur in connection with Complaint Case No. 1453(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
